Divorce and Money: How to Protect Your Financial Future

February 7, 2025 By Richard Shannon

Divorce can have a big impact on your finances.

Without careful planning, you might face unexpected financial problems that could last for years. Whether you’re thinking about divorce or already in the process, it’s important to protect your financial future. If you’re in Austin, Texas, working with a knowledgeable family law attorney can help you secure your assets and make informed decisions.

1. Know Texas Community Property Laws

Texas is a community property state. This means that most things you and your spouse earned or bought during the marriage are owned by both of you and usually divided in a divorce. However, this doesn’t always mean a perfect 50/50 split. The court considers factors like each person’s income, financial needs, and contributions to the marriage. Understanding these laws can help you prepare for the division of assets.

2. Protect Your Assets Early

If divorce is coming, start organizing your financial documents. Gather records of income, expenses, bank accounts, debts, and investments. Keep copies of tax returns, mortgage papers, and retirement accounts in a safe place. This information will be useful when negotiating a fair settlement.

3. Plan for Retirement Accounts and Pensions

Retirement accounts and pensions can be among the most valuable things to divide in a divorce. Texas courts usually consider them community property, but how they are split depends on when the money was earned. Some retirement plans require a special court order, called a Qualified Domestic Relations Order (QDRO), to divide the funds without tax penalties. Talking to a financial expert and your lawyer can help you handle this correctly.

4. Watch Out for Hidden Debts

Many people focus on splitting assets but forget about debts. Any debts you and your spouse took on during the marriage—like credit cards, loans, or mortgages—need to be dealt with. Your divorce agreement should clearly say who is responsible for each debt. Otherwise, if your ex doesn’t pay, creditors may still come after you for the money.

5. Adjust Your Budget and Financial Plan

Life after divorce can bring big financial changes. You may need to find a new place to live, change your spending habits, or rethink your financial goals. Making a realistic budget will help you stay financially secure. A financial planner can help you make smart decisions about your future.

6. Update Your Will and Beneficiaries

After a divorce, update your legal documents, including your will, power of attorney, and any trusts. You should also check and update who will receive money from life insurance policies, retirement accounts, and other financial plans. This ensures that your assets go to the right people.

7. Hire an Experienced Austin Divorce Attorney

Divorce can be legally and financially complicated. Having a skilled attorney by your side is essential. An experienced Austin divorce lawyer can help you understand Texas laws, negotiate fair agreements, and protect your financial future.

Divorce can bring financial challenges, but with careful planning and good legal advice, you can move forward with confidence. By understanding Texas laws, organizing your finances, and working with experienced professionals, you can build a secure financial future.
