A claim of family violence can be both a civil and a criminal matter. On the civil side, the alleged victim of violence may apply for a civil Protective Order. In some situations, if police are called, a person may be arrested. If that happens, a Magistrate may issue an Emergency 30 day Protective Order. You could be excluded from your home. On final hearing, a Protective Order might be issued for 2 or more years. You could be ordered to stay away from the other person and their home and work place. You would be prohibited from having any firearms.
A charge of assault-family violence might also be filed. This charge could be a felony and you would be facing jail time. You would need to hire a criminal defense attorney or ask the court to appoint a public defender to represent you if you lack the money to hire a private attorney.
